Contractual Relationship

These Terms of Use ("Terms") establish a legal contractual relationship between you and Trustotrycare Private Limited ("Trustotrycare"). You are an independent service provider (such as an ambulance driver, nurse, nanny/babysitter, physiotherapist, caregiver, dresser, or provider of medical equipment on rent). Trustotrycare is a private limited company registered in India, with its registered office at 62-Dial Fort Colony, Vishnupuri - 3rd Road, Aliganj, Lucknow, Uttar Pradesh - 226024.

These Terms apply to your use of or access to services provided by Trustotrycare — such as its mobile application, website, content, products, and other digital features.

Please read these Terms carefully before using the services.

Your use of or access to the services indicates your agreement to these Terms, and this agreement establishes a valid contractual relationship between you and Trustotrycare. If you do not agree to these Terms, you may not use or access the services.

These Terms supersede any prior oral or written agreements.

Trustotrycare reserves the right to terminate these Terms or any service, or restrict your access to the services, at any time and for any reason, without prior notice.

Certain specific services (such as subscription plans, promotional offers, or special programs) may be subject to additional rules or terms. Such additional terms shall be deemed part of these Terms for the relevant service. In case of conflict between these Terms and the additional terms, the additional terms shall prevail.

Trustotrycare may revise these Terms from time to time. The revised Terms shall take effect upon being publicly published by Trustotrycare. Continued use of the services constitutes your agreement to the revised Terms.

As per its Privacy Policy, Trustotrycare may collect and use your personal information in connection with the services. In case of disputes, accidents, or complaints involving you and any third party (such as users or other service providers), Trustotrycare may share your necessary information (such as name, contact details, etc.) with insurance companies, law enforcement agencies, or dispute resolution agencies.

The Services

Trustotrycare provides the following services:

(a) A technology platform through which users (such as patients or their relatives) can book and schedule medical transportation or home healthcare services via the Trustotrycare mobile app or website, with independent service providers (such as ambulance drivers, nurses, physiotherapists, caregivers, etc.).

(b) Providing users with payment facilities, service-related information, complaint/problem/query resolution, pickup arrangements (such as from hospitals, homes, or airports), and home healthcare services at their residence.

(c) In some cases, Trustotrycare may provide users with subscription plans, discount packages, or promotional offers, enabling them to avail discounts on service charges.

Unless you have a separate written agreement, these services are available only for personal and non-commercial use.

You acknowledge that Trustotrycare itself does not provide ambulance, nursing, logistics, or healthcare services (such as food delivery, medicines, diagnostics, or medical consultation), nor does it operate as a transportation service provider.

All such services are provided by independent third-party service providers (like you — ambulance drivers, nurses, babysitters, physiotherapists, caregivers, etc.), who are not employees of Trustotrycare. The interaction between service providers and users is facilitated through Trustotrycare’s technology platform.

User Conduct

As a service provider (such as ambulance driver, babysitter/nanny, caregiver, physiotherapist, etc.), you fully agree to comply with all guidelines, rules, and terms prescribed by Trustotrycare Pvt. Ltd., along with all applicable laws enforced by the Government of India.

Your key responsibilities include:

(a) You will not use the services for any unlawful, unethical, or unauthorized purpose.

(b) You must always maintain respectful, safe, and professional behavior with patients, users, passengers, or their relatives.

(c) You must ensure the cleanliness, proper maintenance, and functionality of vehicles, equipment, and other materials used during the service.

(d) Any personal or medical information of users (such as address, mobile number, medical reports, etc.) must be kept confidential and shall not be shared with any third party without prior written consent.

(e) Any form of misconduct, fraud, misinformation, or deliberate disruption during the service is strictly prohibited.

If any unlawful, unsafe, abusive, or inappropriate conduct is found, Trustotrycare Pvt. Ltd. reserves the right to suspend or permanently terminate your services. Additionally, the company may impose penalties and initiate legal action against you if required.

Mandatory Authorizations & Documents

The service provider must ensure possession of all valid and updated authorizations and documents. These include, but are not limited to, the following:

For Patient Ambulance & Dead Body Ambulance Services

Vehicle-related Documents

Commercial Vehicle Registration Certificate (RC):

The ambulance must be registered under the "Ambulance" category and approved by the Transport Authority.

Fitness Certificate:

A valid certificate issued by the Regional Transport Office (RTO), confirming the roadworthiness of the vehicle.

Permit (State / National):

A valid operational permit issued by the relevant State Transport Department.

Pollution Under Control (PUC) Certificate:

A valid PUC certificate showing compliance with environmental standards.

Insurance (Comprehensive or Third-Party):

A valid insurance policy covering both the vehicle and the passengers.

In the case of a Dead Body Ambulance (Mortuary Van / Freezer Box Vehicle), the insurance must also cover the specialized equipment (freezer box, etc.) fitted in the vehicle.

Driver-related Documents

Driving License (LMV–TR or Commercial License – as per State Law):

The driver must hold a valid and active Light Motor Vehicle – Transport (LMV-TR) license.

In some states, a Commercial Driving License is mandatory.

Driver’s Identity & Address Proof:

Acceptable documents include Aadhaar Card, PAN Card, Passport, or copy of Driving License.

Medical Fitness Certificate:

A valid medical certificate confirming the driver’s physical and mental fitness to operate an ambulance.

Mandatory background verification of the driver.

Ambulance Equipment Certification (where applicable):

The ambulance must mandatorily be equipped with the following essential equipment: according type of ambulance -

First Aid Kit

Stretcher

Oxygen Cylinder (with flow meter)

Portable Suction Machine

Defibrillator (if ALS Ambulance)

Fire Extinguisher

Freezer Box (mandatory for Dead Body Ambulance / Mortuary Van only)

Professional Requirements (where applicable):

The ambulance driver must have a minimum of 2 years of professional driving experience.

Ability to check and operate oxygen cylinders and other medical equipment before travel.

For patient transport and emergency ambulances, presence of paramedical staff is mandatory.

For dead body / freezer box ambulances, the freezer unit must be duly installed and confirmed functional before dispatch.

Service Provider Commitments -;

You cannot demand any extra charges, tips, or unauthorized fees from users (patients or their family members).

You must only accept service requests received through the Trustotrycare platform.

The service charge will be displayed only in the app; under no circumstances can it be altered/modified.

In case of any accident, dispute, or complaint, you must immediately notify Trustotrycare.

(1) Age Criteria:

The minimum age of the service provider must be 17 years or above.

(2) Experience:

Nursing Partner:

The nurse must mandatorily arrange and carry the following instruments while coming for service:

1. Stethoscope

2. Sphygmomanometer (BP Instrument)

3. Thermometer

4. Glucometer (with Strips and Lancets)

5. Pulse Oximeter

Work experience;

The NURSE must have a minimum of 2 years of work experience in a hospital or nursing home ICU Ward."

Administering IV, IM, SC injections

RT feeding

Safe mobilization of patients

Tracheostomy care and suctioning

Foley and Ryle’s tube management

BiPAP machine operation

Monitoring vital signs

Medication management and general care

First aid

Relevant qualification certificate (Degree/Diploma) is mandatory.

PHYSIOTHERAPY PARTNER;

Minimum 2 years of professional experience.

While going for service, the Physiotherapy must mandatorily arrange and carry only their own instruments according to service needs

Relevant qualification certificate (Degree/Diploma) is mandatory.

GDA / Caregiver / Attendant PARTNER:

Minimum 6 MONTH Patient / Old age CARE experience compulsory

Lifting, transferring, and bed care for patients

Feeding

Bathing

Foley’s and Ryle’s tube care

Elderly/patient handling

Medication administration

Assisting the nurse

Emptying urine bags

Diaper change etc

DRESSER PARTNER;

While going for service, the dresser must mandatorily arrange and carry only their own instruments, which include:

1. Scissors

2. Forceps

3. Gauze Holder

4. Cast Removal Machine

5. Sterile Instruments etc.

All other required dressing materials (such as Gauze, Cotton, Antiseptic, Bandage, Tape, etc.) will be provided by the patient/family.

Work experience;

The dresser must have a minimum of 1 year of work experience in a hospital or nursing home."

Medical Equipment Rentals:

All equipment must be clean and in good condition.

The service provider must know how to operate the equipment properly.

Technical staff should be available to provide a demo at the time of delivery and resolve technical issues.

24-hour technical support must be available.

Any technical issue must be resolved within 4–6 hours or the equipment must be replaced.

(3) Required Documents:

Updated CV (Resume) – Mandatory

Aadhaar Card – Mandatory

Other ID proof (PAN Card, Driving License, Ration Card, etc.) – Optional

Copies of qualification certificates/Diplomas/Degrees – Optional

Registration number for Physiotherapists (if applicable)

Babysitter PARTNER:

Minimum 6 MONTH BABY CARE experience compulsory

Feeding and bathing the child

Preparing the child for school

Child care and safety techniques

Educational support

Pamper/diaper change, etc.

Medical Equipment rental / Operator:

1. Presence of Technical Expert at the Time of Delivery is Mandatory

At the time of equipment delivery, it is mandatory for the service provider/partner to send a trained technical expert, who will give a complete demonstration and explanation of the equipment’s operation, usage, precautions, and maintenance to the present healthcare personnel (such as an attendant, nurse, caregiver, or doctor).

2. Full Responsibility for Technical Faults Lies with the Service Provider

In case any technical issue arises during the rental period, the full responsibility lies with the service provider.

Upon receiving a complaint, it is mandatory for the service provider to immediately repair or, if required, replace the equipment without delay.

3. 24x7 Technical Support is Mandatory

In the event of any technical problem at any time during usage, the service provider must provide support within 24 hours. A proper phone/WhatsApp/online support system should be available for the convenience of the client or healthcare staff.

4. Only Trained Professionals May Handle Demo and Installation

Installation, operation, and demonstration of the equipment must be done only by trained technical staff. It is strictly prohibited to assign this responsibility to any untrained or inexperienced person.

5. Delivery of Clean, Safe, and Functional Equipment is Mandatory

Before delivery, the service provider must ensure that the equipment is thoroughly clean, safe, and technically functional.

If any issue, dirt, or damage is found at the time of delivery, the customer has full right to reject the equipment immediately.

6. Penalty Applicable for Delay, Negligence, or Lack of Resolution

If the equipment is not delivered on time, or if there is any negligence in demo/repair/replacement, Trustotrycare Pvt. Ltd. reserves the right to impose financial penalties on the service provider or suspend the partnership.

Professional Behavior:

Service providers must treat every patient, user, and family member with compassion, respect, politeness, and dignity.

Prohibition of Misconduct:

The following behaviors are strictly prohibited:

Misbehavior or use of abusive language towards clients or colleagues

Verbal or physical violence

Sexual harassment, threats, or any form of discrimination

Consumption of alcohol or intoxicating substances while on duty

Safe Practices:

The service provider must prioritize the safety and well-being of the patient at all times.

Driving or delivering services under the influence of intoxicants is strictly prohibited.

All safety measures such as masks, gloves, and sanitization must be followed mandatorily.

LICENSE

Subject to your full compliance with these Terms, Trustotrycare Pvt. Ltd. grants you a limited, non-transferable, non-exclusive, revocable, and non-sublicensable license to:

(a) Access and use the application on your personal device solely for the purpose of using the services; and

(b) Access and use the content, information, and related materials made available through the services for personal and non-commercial purposes only.

This license is limited to the purposes stated above.

All rights not expressly granted herein are reserved by Trustotrycare Pvt. Ltd. and its licensors.

RESTRICTIONS

While using the services, you shall not:

(a) Remove any copyright, trademark, or other proprietary notices from the services;

(b) Reproduce, modify, create derivative works from, distribute, license, lease, sell, resell, transfer, publicly display, stream, broadcast, or otherwise use the services, unless explicitly permitted by Trustotrycare Pvt. Ltd.;

(c) Decompile, reverse engineer, or disassemble the services (unless explicitly permitted by Indian law);

(d) Link to, mirror, or frame the services;

(e) Use any bots, scripts, or automated programs to scrape, index, survey, or mine data from the services;

(f) Attempt to gain unauthorized access to or disrupt the operation of the services or their related systems and networks.

PROVISION OF THE SERVICES

You acknowledge that the services may be made available under various brand names or service options of Trustotrycare Pvt. Ltd., such as:

“Trustotrycare Ambulance,” “Trustotrycare Nursing,” “Trustotrycare Physio,” etc.

You also agree that the services may be provided through:

(a) Affiliates of Trustotrycare Pvt. Ltd.;

(b) Independent third-party providers (e.g., ambulance drivers, nursing agencies) who hold valid licenses or permits.

THIRD-PARTY SERVICES AND CONTENT

The services may be linked to or accessed through third-party services or content (such as advertisements, links, or device integrations) over which Trustotrycare Pvt. Ltd. has no control.

You acknowledge that such third-party services and content may be subject to their own terms of use and privacy policies.

Trustotrycare Pvt. Ltd. neither endorses nor takes responsibility for such third-party services.

If you access the services using a third-party device (such as Android), the respective device provider will be considered a third-party beneficiary of these terms, but will not be responsible for the provision or support of the services.

OWNERSHIP

The services and all rights, titles, and interests related thereto shall remain the exclusive property of Trustotrycare Pvt. Ltd. or its licensors.

These Terms and your use of the services do not grant you any rights except for the limited license provided above.

Specifically, you are not granted the rights to:

(a) Use the services beyond the limited rights expressly granted.

(b) Use the names, logos, products, services, trademarks, or service marks of Trustotrycare Pvt. Ltd. or its licensors.

SERVICE STANDARDS

Service providers must adhere to the following standards:

Give priority to cleanliness, punctuality, and professional behavior.

Ensure accurate and proper documentation of processes, services, and client updates.

NETWORK ACCESS AND DEVICES

You are responsible for obtaining the necessary data network access to use the services.

If you access the services via a wireless-enabled device, data and messaging charges may apply from your mobile network, and you will be solely responsible for these charges.

You must also ensure that you have the proper hardware or device to access and use the services and application, and keep it updated as needed.

Trustotrycare Pvt. Ltd. does not guarantee that the services or any part thereof will function without error on a particular device or hardware.

Additionally, Trustotrycare Pvt. Ltd. will not be responsible for technical delays or failures due to the inherent limitations of the internet or electronic communication.

PAYMENT

1. Definition of Service Charges:

Trustotrycare Pvt. Ltd. functions as an aggregator platform, facilitating interactions between service providers (such as nurses, physiotherapists, babysitters, ambulance drivers, etc.) and service consumers.

For each successfully completed service, the company collects a fixed service charge (Commission/Platform Fee) from service providers for using its platform.

2. Rate of Service Charges:

The rate of service charges may vary depending on the nature of the service, location, time, and the amount paid by the customer.

Example:

If the customer pays ₹100 and the service charge is 10%, then:

First, applicable government taxes (such as GST, gateway charges, etc.) will be deducted.

After that, the service charge (10%) will be calculated on the remaining amount.

The company’s share (service charge) will be deducted, and the balance will be paid to the service provider.

3. Mode of Payment:

Payments to service providers will be made through online methods such as UPI, bank transfer, or other options specified by the company.

Payments are generally made within 24 hours to 5 business days after service completion.

The payment timeline will depend on the type of service and the verification process.

4. Taxes and Deductions

The company will deduct all applicable taxes (such as GST) on the service fee as per the law.

If the company has provided any advance payment, equipment, or other assistance to the service provider, it may be adjusted against the payment due to the service provider.

5. Revision of Service Fees

Trustotrycare Pvt. Ltd. may revise its service fee rates from time to time.

Any changes will be notified to service providers in advance.

6. Charges for Non-Compliance

If the service provider is negligent, fails to provide services on time, misbehaves with the customer, or violates the company’s policies, the company may impose a penalty fee or deduct additional amounts from the payment.

Apart from service fees, Trustotrycare Pvt. Ltd. does not automatically provide any portion of your payment as a “tip” to the provider.

However, after the completion of the service, users may voluntarily give a tip to the provider — this is completely optional.

After the completion of the service, the user will also have the opportunity to provide a rating and share feedback regarding the service.

Repair, Uniform, or Cleaning Fees

If, during the service provided under your ID, any damage is caused to the user’s or company’s property beyond normal wear and tear, or if unusually excessive cleaning is required, then all such repair or cleaning costs will be the full responsibility of the service provider.

Replacement / Leave Policy

Trustotrycare Pvt. Ltd. does not generally allow voluntary leave for service providers.

If any user wishes to grant leave, it will be entirely at the user’s discretion, but the user is not obligated to approve leave.

Abandonment / Replacement Request

Only in emergency situations may the service provider submit an Abandonment or Replacement Request with valid reasons.

Each service provider may make a maximum of 2 Abandonment or Replacement Requests per month.

If a provider exceeds this limit, the company may reject such requests, impose a fine, or suspend the provider’s account.

Fine Policy

The imposed fine will be deducted from the total earnings of the service provider.

The amount of the fine will depend on the duration of the service and the number of Abandonment / Replacement Requests.

Replacement Confirmation

Once a replacement has been confirmed, the original service provider cannot leave the duty until the alternate service provider has arrived at the service location and officially taken charge.

Repair / Cleaning Complaints

If any repair or cleaning requirement is reported by a user or the company, and Trustotrycare Pvt. Ltd. finds the complaint valid at its discretion, the company may directly deduct the related cost from the service provider’s payment.

The deducted amount will be transferred to the concerned user or the company, and this amount will be non-refundable.

7. Cash Transactions Prohibited

A.Service providers are strictly prohibited from collecting any cash payments directly from users under any circumstances.

All payments must be made only through the official payment system of Trustotrycare Pvt. Ltd.

If any service provider accepts direct cash or offline payments from a user, the company reserves the right to immediately suspend or terminate the service provider’s account.

In such cases, the company may impose a penalty by deducting the amount from the service provider’s pending/previous payouts.

Furthermore, the company also reserves the right to initiate legal action against the service provider, if deemed necessary.

B. The reminder for any pending dues (Dues Amount) will be sent to the service user by the company, and it shall also be the responsibility of the service provider to ensure timely reminders. Submission of the Completion OTP after the service is mandatory. Until the OTP is submitted, the service provided will not be considered complete and the payment will remain on hold.

8. Restriction on Medical Advice:

Service providers are strictly prohibited from giving any kind of medical advice, diagnosis, investigation, or treatment suggestions under any circumstances.

The service provider must only follow the instructions provided by doctors, hospital discharge papers, or the family members of the patient.

Failure to comply with this may result in the company imposing a penalty, suspending/terminating the service provider’s account, and taking legal action if necessary.

DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY

Disclaimer:

Trustotrycare Pvt. Ltd.'s services are provided "as is" and "as available."

Except for any obligations explicitly stated in these terms, the company disclaims all express, implied, statutory warranties — including those of merchantability, fitness for a particular purpose, and non-infringement of intellectual property.

The company does not guarantee that the services will be error-free, uninterrupted, timely, secure, or reliable.

The service provider acknowledges that the entire risk associated with using the services lies with them, unless otherwise required by applicable law.

Limitation of Liability

Trustotrycare Pvt. Ltd. shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or personal/property damage — even if the company was advised of such possibilities.

In particular, the company shall not be liable for any damages arising from:

(i) Your use or reliance on the services, or your inability to access or use them;

(ii) Any transaction or relationship between you and any user or third party.

Furthermore, the company is not responsible for any issues arising from causes beyond its control, such as technical failures, network problems, natural disasters, or compliance with government orders.

You acknowledge that services are provided by independent third-party providers, who may or may not be professionally certified or licensed.

You also understand that Trustotrycare Pvt. Ltd. acts only as an aggregator (intermediary) and, unless explicitly mentioned in this contract, it bears no direct liability for any loss resulting from the services.

These disclaimers and limitations of liability do not restrict any statutory consumer rights, where such limitation is not allowed under applicable law.

OTHER PROVISIONS

Claims of Copyright Infringement:

Any claims related to copyright infringement should be sent to the designated representative of Trustotrycare Pvt. Ltd.

Trustotrycare Pvt. Ltd. may provide you with general notices by posting them on the platform, by sending an email to the email address listed in your account, or by sending written communication to the address provided in your account.

You may give notice to Trustotrycare Pvt. Ltd. via written communication at the following address:
