These Terms of Use, Privacy Policy, and other related documents define the conditions and rules for using the health services, mobile application, and associated functionalities provided by Trustotrycare Private Limited ("Service") !

This document is an electronic record under the Information Technology Act, 2000. It is generated by a computer system and therefore does not require any physical or digital signature.

Please read these Terms of Use carefully before starting to use the Service. By using the Service, you declare that you are at least 13 years old. Additionally, you agree to be bound by and comply with these terms. If you are under 13 years of age or do not agree with these terms, please do not use the Service.

The Company reserves the right to modify, amend, or remove these terms or any related documents at any time, at its sole discretion. Continued use of the Service will constitute your agreement to such changes. It is your responsibility to periodically review these terms.

Registration:

To use the Service, you will need to register and provide some information about yourself. The collection of your information is governed by our Privacy Policy, which is available on the client app. By using the Service, you consent to the use of your information in accordance with our Privacy Policy, including being contacted via email or SMS.

You will be provided with a User Account for personal use, requiring a Username and Password. You will be responsible for all activities that occur under your account.

You must comply with the following:

1. You are solely responsible for the accuracy, quality, legality, reliability, and appropriateness of all information you provide.

2. Keep your password and account information confidential.

3. Take commercially reasonable steps to prevent unauthorized use of the Service and promptly notify the Company in case of any unauthorized use.

4. Comply with all applicable local, state, and central laws while using the Service.

5. Do not share your username and password with anyone.

6. Your username and password are for your personal use only.

7. If a friend, family member, or any other person uses your account, the Company will not be responsible for any activity conducted through that account.

10. User Risk: The user acknowledges that they use the services at their own risk. Trustotrycare acts only as a platform and does not guarantee the quality or outcome of the service.

11. Emergency Services: In any emergency situation, the user should immediately contact a hospital or emergency medical service and call for an ambulance. Our services do not provide emergency medical assistance.

12. Limitation of Liability: The Company or its service providers shall not be held liable under any circumstances for the following:

Improper Use or Overdose of Medication

Medical Complications

Emerging or Worsening Health Issues

Account Security: The user is solely responsible for maintaining the security of their account. The company shall not be liable for any losses resulting from unauthorized uses

Service Provider Safety: Any form of misconduct, threats, or inappropriate behavior toward a service provider is strictly prohibited. If such behavior is found, the service may be terminated immediately.

Insurance & Agency Requirements: Trustotrycare Pvt. Ltd. does not fall under any insurance scheme. If a user wishes to avail services under an insurance plan, they must directly contact their insurance company and fulfill their requirements.

Conduct with Service Providers: Users must treat service providers with respect and courtesy. It is strictly prohibited to directly call, personally contact, or privately book the service providers.

Care, Food & Accommodation: If the service is booked for more than 8 hours, the user must provide food and, if required, accommodation for the service provider. If the service is for 24 hours, the service provider must be given at least 7 to 8 hours of sleep/rest per day.

Non-Discrimination: Users shall not discriminate against service providers or any other individual based on gender, caste, religion, language, community, or any other grounds. Any such act may result in termination of service.

Support in Health Recovery:

The service provider is responsible only for supporting the user in health recovery. The service provider shall not be held responsible for any type of medical complications, worsening of condition, or unforeseen incidents. Since the provider is not a doctor, proper medical consultation is mandatory in case of serious medical decisions or emergencies.

Live Service Leave Policy:

Trustotrycare does not grant any type of leave to service providers during live service. If the user voluntarily allows the service provider to take a break during the ongoing service, and the provider does not return on time or returns late, the full responsibility shall lie with the user. Trustotrycare will not be held liable in such circumstances.

Consent: By using the service, the user declares that they fully agree to and will comply with all the above terms and conditions.

General Terms:

Trustotrycare Pvt. Ltd. ("Company") grants service users ("you") a non-exclusive, non-transferable, and limited right to use the services provided through its platform, software, technical mediums, and electronic documents, subject to the terms of this service usage agreement. This right is strictly limited to personal use and does not permit any commercial or unauthorized use.

This service is designed to help users achieve their health goals by adopting healthier habits in their daily lives. The company recommends that users consult with their certified healthcare provider before beginning the service.

Responsibility for Health and Participation:

By using the service, you affirm that you are physically capable of participating in the service, especially in activities that may involve changes in your diet, exercise, or lifestyle. If you suffer from any chronic illness or medical condition, it is your responsibility to seek appropriate medical advice before starting the service.

Trustotrycare Pvt. Ltd. does not guarantee any specific results, as each user’s experience and outcomes depend on their individual health conditions.

Matching with Healthcare Provider and Service Provision:

Based on the information you provide (such as type of service, location, time, and duration), the company matches you with a certified and registered independent service provider (such as a nurse, physiotherapist, caretaker, or driver).

These service providers are not employees of Trustotrycare Pvt. Ltd., but independent contractors who offer their professional services under contract.

The service provider visits your given address to provide the service, which is entirely non-clinical and related to care/assistance.

The services provided by the service provider are based solely on the information you have provided and, where applicable, the doctor's recommendation.

Selection and Replacement of Service Provider:

We strive to ensure that the same service provider remains assigned to you throughout the entire service duration.

However, based on necessity or availability, the company reserves the right to replace the service provider and will inform the user in advance in such cases.

Communication and Guidance:

Healthcare providers may contact you via phone, video call, email, or other digital means.

These providers work to support, guide, and motivate you in achieving your health goals. However, they do not provide medical consultations or diagnoses.

Service Limitations:

This service is strictly limited to non-clinical care, guidance, and support.

It is not an emergency medical service. In case of an emergency, please contact your local emergency services or nearest hospital.

Intellectual Property Ownership:

Except for the limited license and usage rights granted to the user under these Terms of Use, all technologies, software, and content used in the service (including patents, copyrights, trademarks, trade secrets, hardware, other technologies, their derivatives, and associated goodwill) are solely owned by the company and/or respective third parties.

The user agrees that all text, graphics, photographs, trademarks, logos, user interfaces, artwork, computer code, and other related content available in the service are the property of Trustotrycare Pvt. Ltd. or third parties, and all such content is protected by applicable trade dress, copyright, patent, trademark, and other intellectual property and unfair competition laws.

Unless expressly permitted in these terms, no part of the service or its content may be copied, republished, posted, displayed, translated, or transmitted for any commercial purpose without prior written permission from the company.

Confidentiality:

We protect and use your personal information in accordance with our Privacy Policy. You agree that any confidential information related to the company that you receive during the course of using the service shall not be shared, published, or used for any purpose without prior written consent from the company.

Non-Confidential Information:

Subject to the Privacy Policy, any suggestions, questions, or other communications shared by you through the service shall be considered non-confidential, and the company shall have no obligation regarding such information. Trustotrycare Pvt. Ltd. is free to use any ideas, techniques, knowledge, or processes contained in such information for the purposes of product development, service improvement, creation, marketing, or any other purpose.

Content:

The information provided through the service is for general informational purposes only. We do not guarantee the accuracy, completeness, or usefulness of this information. Any reliance the user places on this information is strictly at their own risk.

The service may include health- and medical-related information; however, under no circumstances should this be taken as a substitute for medical advice, diagnosis, or treatment. It is essential to consult a qualified medical professional for any health-related decisions.

The information provided through the service is based on the user’s own inputs; therefore, the responsibility for its authenticity also lies with the user. We shall not be liable for any loss resulting from actions taken in reliance on this information.

Service Access and Changes:

Trustotrycare Pvt. Ltd. reserves the right to modify, suspend, or terminate its services or any related content at any time without prior notice.

If the service or any part of it becomes unavailable at any time or for any period, the company shall not be held responsible. From time to time, we may restrict access to parts of the service or the entire service for users.

We strive to keep the content of the service updated and accurate, but we do not guarantee its completeness or timeliness.

Service Charges:

All payments for services booked through Trustotrycare Pvt. Ltd. shall be made only in Indian Rupees (INR). The following online payment methods may be used: UPI, net banking, debit card, credit card, and other authorized digital payment options.

1. Advance Payment:

Partial Payment Scenario:

If, at the time of booking confirmation, the user has made only a partial payment, and the remaining amount is considered as a promise to be paid either before the service goes Live or immediately after the service goes Live, and the company/service provider has set the service as Live,

but the user, after the service goes Live, shows negligence/failure (Ignore/Fail) in making the due payment by the scheduled date,

then the company may grant the user up to 24 hours prior to the expiry of the partial payment to complete the payment.

After this period, the company reserves the right to Stop (Terminate) the service.

This duration will depend upon the Category, Duration, and Due Amount of the service.

Reminder Policy:

In such a situation, the company, at its discretion, may send a payment reminder (WhatsApp / Pop-up / Call) or a Live Service Stop Notification 24 hours prior, or may choose not to send it.

2. Service Start Time Charges:

For some services, additional charges may be applicable when the service provider begins the service. These charges will be clearly communicated to the user before booking.

3. Fee Revisions:

All service charges are subject to change. Trustotrycare Pvt. Ltd. reserves the right to revise fees at any time without prior notice, as long as the service has not already been booked. For live or already booked services, the charges applicable at the time of booking will remain in effect.

Rewards:

Offers, referral codes, promotional rewards, or any other form of reward provided by Trustotrycare Pvt. Ltd. are non-transferable and cannot be redeemed for cash. These rewards are valid only under the specified terms and conditions.

Cancellation / Live Service Termination Request:

Trustotrycare Pvt. Ltd. reserves the full right to accept or reject any cancellation or live service termination request, in accordance with its defined cancellation policy.

1. Acceptance or Rejection of Request:

Users may request cancellation or termination of service, but the company is free to decide whether to accept the request or not. This decision will be based on the nature of the service, its status, and applicable policies.

2. Cancellation Charges:

Certain services may be subject to cancellation charges, which will be disclosed to the user at the time of booking. If the service has already started, partial or full charges may apply in the event of cancellation.

3. Conditions for Terminating a Live Service:

If a user requests to abruptly stop a live service, the company will make the final decision considering valid reasons, the service provider’s safety, the situation, and payment procedures.

4. Policy Changes:

Trustotrycare Pvt. Ltd. reserves the right to modify its cancellation and termination policies at any time without prior notice. The latest policies will be available on the company’s website or application.

This limitation of liability applies regardless of the legal theory—contract, tort, negligence, or otherwise—even if the company has been advised of the possibility of such damages.

If, under any circumstance, the company is held liable, its maximum total liability shall be limited to the total amount paid by the user in the past 12 months.

Governing Law:

You agree that the use of this service and any dispute arising therefrom shall be governed by the laws of India, specifically under the jurisdiction of the State of Uttar Pradesh.

Severability:
